Article 1 – General Terms and Conditions of Sale
These general terms and conditions govern the relations between Easy Surgery, 8 rue des Fabres, Marseilles, and the customer for the supply or products and/or services to the customer. Any order implies unconditional acceptance of these terms and conditions of sale. In the event of a contradiction between these general conditions of sale and any document emanating from the buyer having his purchasing conditions, our conditions will prevail.
Article 2 – Sales Price
The prices appearing on the website are mentioned for information only and do not bind us in any way unless otherwise agreed in writing. They may be subject to change at any time.
Applicable prices are those in effect at the time of your order. We reserve the right to modify the characteristics of the items appearing on our prices or to cease the sale of a model without prior notification or obligation on our part.
The prices shown are net ex-works prices, including packaging.
For shipping costs, the customer shall refer to the information provided when submitting their order.
Article 3 – Order
Placed orders shall commit us only after written acceptance by our company.
Article 4 – Payment
All of our invoices are stipulated payable to our head office by whatever payment method is used.
Our terms and conditions include payment by credit card for any purchase through our website www.cataract-instruments.com
Payment by bank transfer is accepted by customer preference.
Payment by check is possible for mainland France. In this case, the check must be received before the order is prepared.
No discount is given for early payment.
The purchaser shall incur a monthly penalty of 3% of the invoice amount, excluding taxes, for any delay in payment.
Article 5 – Shipping and Delivery
Our goods, even when shipped at no charge, are always shipped at the risk of the recipient. It is incumbent on the purchaser to inspect the condition of the supplies upon delivery and to note any reservations immediately with the carrier.
Except when picked up by the purchaser, goods are shipped by Easy Surgery by their chosen means.
Delivery times are always provided as an estimate.
Delays can in no way justify order cancellation, a price reduction, or the allocation of damages and interest.
The Customer cannot refuse to receive the goods in the event of a partial delivery.
Article 6 – Retention of Ownership
By express agreement and as an essential condition for any sale, the transfer of ownership for delivered goods shall be suspended until full payment of the price by the purchaser (French law 80- 335 of May 12, 1980).
Failure to pay shall bind the customer to return the entire order in its original condition and at the customer’s expense.
Article 7 – Return – Warranty
No return of goods shall be accepted without our written consent. Our consent shall in no way imply acknowledgment of liability.
The costs and risks of the return are always the responsibility of the purchaser.
Return costs are the responsibility of the customer unless we have agreed otherwise in writing.
Article 8 – Modification
We reserve the right to make any changes to the presented products in line with technological advancements in the market and changes made by suppliers. Product photos and characteristics are non-binding.
Article 9 – Prices
The indicated prices are expressed in Euros, excluding tax. Prices do not include packaging and shipping costs.
Article 10 – Photos and Inventory
Photos presented on the www.cataract-instruments.com website are non-binding. Easy Surgery reserves the right to offer an equivalent item if goods are out of stock. Photos on www.pmd-medical.com are the property of PMD Medical. Any copy or reuse must be requested in advance at email@example.com
Article 11 – Jurisdiction
The Commercial Court of Nîmes shall have full jurisdiction in the event of a dispute of any nature, including a dispute over the execution of this sale.
This clause shall apply even when the warranty is applied or when there are multiple defendants, regardless of the mode and method of payment.
